I bought one of these from Sporty's and it all works good eccept for the GPS NAV function. When I manually program in a fix and select GOTO it freezes

i think you have to be within range of the ILS. Mine only works on 1 local ILS when I'm on the ground.

There is nothing in the Operation Manual that specifies max GPS altitude, but the industry standard for portable devices is 70,000 ft.

What type of battery is included?

Comes with a Li-Ion Battery Pack. However it does have an Alkaline Battery Tray that takes 6 AA batteries which are not included.

I leave appx 9 miles from airport why is it that i can only hear the planes not the tower isnt the tower longer range

VHF is pretty much line of sight, so if you can't see the antennas for their radios then you aren't going to get a good signal. For example, I lived in Alameda CA, right off the end of 10R at Oakland north field. I used a good discone broadband receiving antenna and a very good Kenwood D710 radio to listen to local traffic. I was 11.43 miles from SFO tower and could not hear tower or ground. The earth is in the way, well the SF Bay anyway. Another day I was at Cal State East Bay waiting for my daughter, same radio and a 2m band transceiver antenna. Even with an unmatched antenna, from there I got SF ground and tower crystal clear from 18 miles and could also hear San Jose 22 miles away. All this time I could also hear aircraft out over Nevada, more than 100 miles away, and on approach at all the Bay Area airports.
